Urgent - please object to a proposed Seasonal (9 month) TRO in Hampshire:

OBJECTIONS: All objections and other representations in respect of this
proposal must be sent in writing to the Head of Countryside, Hampshire County
Council, Room 200, Mottisfont Court, Winchester SO23 8ZF or via email to
row.notices@hants.gov.uk no later than 28 October 2011.

Main objections to make include:

- the Council is failing in its duties to secure the expeditious, convenient and safe movement of vehicular
and other traffic (including pedestrians) (Section 122 of the Road Traffic Regulation Act 1984) and Section 130 of the Highways Act 1980 to assert and protect the rights of the public to the use and enjoyment of any highway.

- that less restrictive measures have not been tried first - the Council's TRO Policy, that states: "the response to a problem or a potential problem should always be the least restrictive necessary. The Council will consider a series of other options before considering the implementation of a TRO. If a TRO is to be considered it should be the least restrictive necessary."

- that motorcycle use is sustainable on this route - repairs have been made which will sustain motorcycle use

- that the TRO treatens trail riding as a legitimate and legal hobby

etc etc.............

18 Month experimental TRO excluding all vehicular traffic and subsequent permanent TRO using a 2 day per month permit scheme.

Due to the nature of this byway straddling two local authority areas there is a necessity to object twice.(which is helpful)

First and foremost we are happy to have a self imposed restriction on the use of these Byways until such times as the necessary repairs are completed.
What we are objecting to is the limited usage we are being offered with this experimental scheme which is likely to become a permanent situation on completion of the work .We would like to see a fairer system of a permanent permit scheme introduced as used in other areas within Kent (Bredhurst & Lenham) whereby the vehicles are registered with the Local Authority and the code for any access gate is issued with a pass which can be displayed for any interested party to examine.
Also putting the onus on a run leader to ensure the legality of all members in a group is an alarming prospect,and one which I as a run leader wouldn't want to take on.
I have also objected to the inference that by using a MPV on a Byway we are somehow connected to or encouraging criminal and anti social behavior.
I have attached the original letter outlining the Experimental TRO from Graham Rusling of the KCC PROW office

We Have just received the long awaited notification of the proposed Experimental TRO (banning all motor vehicles and horse drawn carriages) on the Holly Hill Byways network (MR45A,NS245, NS221, RS221 and Chapel Lane (UCR)).
The original idea of a permanent TRO to be then lifted 3 years later has
been dropped as KCC have accepted they can't be trusted to remove it after
the 3 years. The revised Order is for 18 months and will enforced with
horse friendly barriers at the start of each byway and the Chapel Lane UCR
in Medway.
There will be limited access on 2 days every month for those users who
have applied for a permit. There will be a maximum of 16 motorcycles per day but larger groups, if properly
marshaled may be accommodated.

Only one permit per group is required, but the group leader must list all of
the vehicle registration numbers, drivers/riders names and is responsible
for the conduct of the group.

The original proposal (the 'Rosegarth' scheme) would have the gates left
open all day a couple of times a year. As we believed this may be abused
instead combination locks will be fitted in place of the normal key locks on
the 'open' days, the combination will be changed each month and only permit
holders will be given the combination number.

As the TRO's are being made by 2 different local authorities comments on the
Tonbridge and Malling and Gravesham Byways (MR45A, NS245 & NS221) to Graham
Rusling at KCC
Civic HQ
Gun Wharf
Dock Road Chatham
ME4 4TRand Medway

and objections to the TRO on
byway RS221 & UCR
Chapel Lane to:

Medway Council
Regeneration, Community and Culture
Civic Headquarters
Gun Wharf
