There is a legal notice to serve on the authority that will get them moving for you - unfortunatley it was dera old Brian Thompson , now departed, who came up with the info - try contacting Robin Hickin he may recall the exact details

You are probably thinking of the Highways Act 1980 section 130A proceedure already mentioned.

As already discussed, if the gate is not authorised or recorded as a limitation then it is almost certainly illegal and section 130A would probably be appropriate.

There is a fairly good explanation below but there was also advice from Brian as you say. I'll try and find a copy to post if I can.

Could not the person who locks/unlocks the gate at 7am or 5pm be asked who he/she is acting on behalf of?

Section 137 of HA80 is another good one for obstructions on public rights of way.This is probably one that the magistrates will know better than a S130A

He is just a nasty old man who is acting on his own behalf and the law is in such a mess surrounding that area that he gets away with it because the County Council claims it is not their responsibility.
