What seems to have been forgotten here is that an MOT Test Certificate (Pass) is a legal requirement for any vehicle over 3 years old be to taxed and driven/ridden on the highway unless it is being taken for a pre-booked MOT test.
That is as far as it goes. To pass an MOT test the vehicle does not have to be in a state that it can legally be ridden on the highway.

If stopped by a police officer or examined following an accident then Construction and Use legislation is what is used to determine legality of the vehicle, irrespective of whether the vehicle passed an MOT test 5 minutes previously or 11 months 30 days previously.

If you wish to discuss the requirements of an MOT test do so.
If you wish to discuss the requirement to be legal riding on the road do so.
But don't mix the two.
